BRAZIL - CLANDESTINE FERTILIZER PLANT IS SHUT DOWN IN PRADÓPOLIS (SP) AFTER TIP-OFF AND SEIZURE OF 475 TONS OF INPUTS

A REGULATORY INSPECTION OPERATION CARRIED OUT BY BRAZIL’S MINISTRY OF AGRICULTURE AND LIVESTOCK RESULTED IN THE SHUTDOWN OF A CLANDESTINE FERTILIZER PLANT IN THE INTERIOR OF SÃO PAULO STATE. THE ACTION TOOK PLACE IN THE INDUSTRIAL DISTRICT OF PRADÓPOLIS AFTER A COMPLAINT WAS FILED THROUGH THE FEDERAL GOVERNMENT’S OFFICIAL OMBUDSMAN CHANNEL, PROMPTING TECHNICIANS FROM THE ARARAQUARA REGIONAL SUPERINTENDENCY TO CONDUCT AN ON-SITE INSPECTION.


DURING THE INSPECTION, OFFICIALS FOUND THAT THE COMPANY WAS OPERATING OUTSIDE THE LAW. THE FACILITY AND ITS PRODUCTS WERE NOT REGISTERED, A MANDATORY REQUIREMENT FOR THE MANUFACTURE AND COMMERCIALIZATION OF FERTILIZERS IN BRAZIL. IN ADDITION, THE PLANT DID NOT HAVE AN ENVIRONMENTAL LICENSE, AN ESSENTIAL DOCUMENT TO ENSURE THAT INDUSTRIAL ACTIVITY DOES NOT POSE RISKS TO THE ENVIRONMENT OR PUBLIC HEALTH.


IN LIGHT OF THE IRREGULARITIES, INSPECTORS SEIZED 475 TONS OF RAW MATERIALS USED IN FERTILIZER PRODUCTION, BOTH IN BULK AND IN BAGS. THE PRODUCTS LACKED IDENTIFICATION OF ORIGIN AND INFORMATION ON COMPOSITION GUARANTEES, MAKING ANY FORM OF QUALITY CONTROL IMPOSSIBLE. AS A PRECAUTIONARY MEASURE, PRODUCTION WAS IMMEDIATELY HALTED.


THE MANUFACTURER WAS FORMALLY NOTIFIED AND WILL HAVE A 30-DAY DEADLINE TO REGULARIZE THE SITUATION WITH THE COMPETENT AUTHORITIES. UNTIL ALL LEGAL REQUIREMENTS ARE MET, THE COMPANY IS PROHIBITED FROM PRODUCING AND COMMERCIALIZING FERTILIZERS. FAILURE TO COMPLY MAY RESULT IN MORE SEVERE SANCTIONS, INCLUDING FINES AND OTHER ADMINISTRATIVE PENALTIES.


THE MINISTRY’S TEAM ISSUED AN OFFICIAL INSPECTION AND ENFORCEMENT REPORT, DETAILING ALL IDENTIFIED IRREGULARITIES. TERMS OF SEIZURE FOR THE RAW MATERIALS AND FINISHED PRODUCTS WERE ALSO ISSUED, ALONG WITH A FORMAL NOTICE REQUIRING THE COMPANY TO REGULARIZE ITS STATUS AND A NOTICE OF VIOLATION, WHICH WILL SERVE AS THE BASIS FOR FORMAL PROCEEDINGS REGARDING THE ILLEGAL CONDUCT.


ACCORDING TO INSPECTORS FROM THE SÃO PAULO SERVICE FOR INPUT AND PLANT HEALTH INSPECTION (SISV-SP), FERTILIZERS PRODUCED WITHOUT OFFICIAL REGISTRATION REPRESENT A SIGNIFICANT RISK TO THE AGRICULTURAL SECTOR. WITHOUT GOVERNMENT OVERSIGHT, SUCH PRODUCTS MAY CONTAIN UNBALANCED FORMULATIONS, CONTAMINANTS, AND EVEN HEAVY METALS. IN PRACTICE, THIS CAN LEAD TO DIRECT LOSSES FOR FARMERS, INCLUDING REDUCED PRODUCTIVITY, SOIL DAMAGE, AND PHYSIOLOGICAL IMBALANCES IN CROPS.


BEYOND ECONOMIC IMPACTS, THE LACK OF AN ENVIRONMENTAL LICENSE INCREASES THE RISK OF SOIL, WATER, AND AIR CONTAMINATION, AFFECTING NOT ONLY AGRICULTURAL ACTIVITY BUT ALSO THE HEALTH OF COMMUNITIES SURROUNDING THE FACILITY. THIS TYPE OF CLANDESTINE OPERATION UNDERMINES CONFIDENCE IN THE AGRICULTURAL INPUTS MARKET AND DISTORTS COMPETITION, HARMING COMPANIES THAT OPERATE IN COMPLIANCE WITH THE LAW.


THE ENFORCEMENT ACTION WAS BASED ON LAW NO. 14,515/2022, KNOWN AS THE SELF-CONTROL LAW, WHICH STRENGTHENS ACCOUNTABILITY AND INSPECTION MECHANISMS IN THE AGRICULTURAL SECTOR, AS WELL AS FEDERAL DECREE NO. 4,954/2004, AMENDED BY DECREE NO. 8,384/2014, WHICH REGULATES THE PRODUCTION AND COMMERCIALIZATION OF FERTILIZERS IN BRAZIL.


THE MINISTRY OF AGRICULTURE EMPHASIZES THAT PUBLIC PARTICIPATION IS ESSENTIAL TO CURB THIS TYPE OF IRREGULAR ACTIVITY.
