BRAZIL - STF AND PGR UNDER CRITICISM AFTER BLOCKING ARREST IN INSS SCANDAL

THE DECISION BY THE SUPREME FEDERAL COURT AND THE ATTORNEY GENERAL’S OFFICE TO DENY THE ARREST REQUEST FOR SENATOR WEVERTON ROCHA, IN THE CONTEXT OF THE OPERATION INVESTIGATING THE SO-CALLED INSS SCANDAL, RAISES QUESTIONS ABOUT THE EFFECTIVENESS OF INSTITUTIONS IN COMBATING CORRUPTION. CRITICS POINT OUT THAT THIS DIFFERENCE IN TREATMENT SENDS A MESSAGE OF IMPUNITY, CREATING THE PERCEPTION OF TWO WEIGHTS AND TWO MEASURES: ONE FOR ORDINARY CITIZENS AND ANOTHER FOR HIGH-RANKING POLITICAL FIGURES. IN THE CASE OF THE INSS SCANDAL, THE IMPACT IS EVEN MORE SERIOUS, AS THE FUNDS INVOLVED RELATE TO SOCIAL SECURITY, WHICH BENEFITS MILLIONS OF LOW-INCOME BRAZILIANS.

BY NOT SUPPORTING THE ARREST REQUEST, THE OFFICE RESPONSIBLE FOR DEFENDING THE PUBLIC INTEREST GIVES THE IMPRESSION OF EXCESSIVE CAUTION OR EVEN COMPLICITY, ACCORDING TO CRITICS. EVEN IF THERE ARE LEGAL GROUNDS FOR THE DECISION, THE POLITICAL AND SYMBOLIC IMPACT IS SIGNIFICANT, UNDERMINING PUBLIC TRUST IN THE INSTITUTIONS.


RECENT DATA SHOW THAT CASES INVOLVING HIGH-RANKING POLITICIANS OFTEN END WITHOUT IMMEDIATE ARRESTS, WITHOUT RECOVERY OF FUNDS, AND WITHOUT EXEMPLARY PUNISHMENTS.
